Iron Man - Instant Win Game Official Rules

  1. NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. MUST BE THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE AND A LEGAL U.S. RESIDENT CURRENTLY RESIDING in AL, CT, DE, FL, GA, HI, IL, IN, KY, ME, MD, MA, MS, MT, NH, NJ, NY, NC, OH, PA, RI, SC, TN, UT, VT, VA, WV, WI, or Washington, DC. TWO (2) WAYS TO PARTICIPATE: From 9/1/08 through 12/31/08 ("Promotional Period"), you may (1) receive an official Game Piece on-package when you purchase any specially marked package of Perdue Refrigerated Breaded Products, while supplies last; OR (2) you may obtain an official Game Piece, while supplies last, and a copy of the Official Rules via mail by sending a self-addressed, stamped envelope to "Iron Man" Instant Win Game Piece Request, Dept. 5798, P.O. Box 3014, Rogers, MN 55374-3014. VT residents may omit return postage. Requests must be postmarked by 12/31/08 and received by 1/9/09. Limit one Game Piece request per outer, postmarked envelope. No mass or mechanically reproduced Game Piece requests will be accepted. Perdue Farms Incorporated ("Sponsor") is not responsible for lost, late, stolen, misdirected, incomplete, illegible or postage-due Game Piece requests. Game Pieces are null and void, and will be rejected if not obtained in accordance with these rules and through legitimate channels; or if any part of the Game Piece is determined by the judging organization to be illegible, reproduced, counterfeited, mutilated or tampered with in any way; or if any Game Piece and/or promotion-related materials contain printing, production, typographical, mechanical or other error. Sponsor's sole liability for any defective Game Piece is limited to replacement with one Game Piece, while supplies last. By participating in the Perdue Refrigerated Breaded Products "Iron Man" Instant Win Game, participants accept and agree to be bound by these Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters related to this promotion. Game ends on 12/31/08 or when all supplies of official Game Pieces are depleted, whichever occurs first.
  2. HOW TO PLAY/CLAIM PRIZE: Cut open your official Game Piece to reveal a message. If your official Game Piece states "Congratulations, You Win!", then you are a potential winner of the prize named pending verification and compliance with these Official Rules. To claim a First Prize or Second Prize, hand print on a 3" x 5" card your complete name, date of birth, street address, city, state, zip code and daytime telephone number with area code and mail along with your entire original official Game Piece to "Iron Man" Fulfillment, Dept. 5798, P.O. Box 3021, Rogers, MN 55374-3021. To claim a Grand Prize, make a photocopy of your official, winning Game Piece for your records. Hand print on a 3" x 5" card your complete name, date of birth, street address, city, state, zip code, and daytime telephone number with area code and mail along with the entire original Game Piece via certified or registered mail to: "Iron Man" Fulfillment, Dept. 5798, P.O. Box 3021, Rogers, MN 55374-3021. DO NOT SHOW OR GIVE ANY PRIZE-WINNING OFFICIAL GAME PIECE TO ANY RETAIL PERSONNEL. RETAIL PERSONNEL ARE NOT AUTHORIZED TO VERIFY OR REDEEM PRIZE CLAIMS. All prize claims must be received by the end of business (5:00 PM EST) on 2/27/09 EST. Sponsor is not responsible for lost, late, illegible, mutilated, misdirected or postage-due prize claims. All submitted Game Pieces become the property of Sponsor and will not be returned. Failure to submit original Game Piece by 2/27/09 will result in forfeiture of prize. Prize claims are subject to verification. In the event of a printing error or the like that results in more winning Game Pieces than available prizes as set forth in these Official Rules, a random drawing will be held from among those holding verified winning Game Pieces to award the number of prizes as stated in these Official Rules.
  3. PRIZES/ODDS: GRAND PRIZE (1): One (1) Grand Prize winner will receive a trip for four (4) to Hollywood, CA. Trip includes round trip coach airfare for winner and three (3) guests from a major airport nearest winner's residence (chosen by Sponsor) to a major airport near Hollywood, CA (chosen by Sponsor); 4-day/3-night hotel accommodations (standard rooms, double occupancy; hotel to be chosen by Sponsor); airport/hotel transfers in Hollywood, CA; and VIP passes for four (4) to Paramount Studios in Hollywood, CA. Any expenses not expressly stated herein, including meals, gratuities and additional transportation, are the sole responsibility of the winner and guests. Winner and guests must travel on same itinerary and must be able to complete travel prior to 12/31/09. If potential Grand Prize winner cannot accept travel prior to 12/31/09, potential winner will be disqualified and Grand Prize will be forfeited in its entirety. Travel subject to blackout dates and restrictions. In the event any guest of Grand Prize winner is a minor, that guest must be accompanied by his/her parent or legal guardian. Sponsor makes no warranty with respect to the Grand Prize and is not responsible for flight cancellation or postponement. The cash equivalent of any portion of the Grand Prize is not permitted, except at Sponsor's sole discretion. Approximate Retail Value ("ARV") of Grand Prize: $7,500; Actual Retail Value of prize may vary depending upon city of departure. Any difference between the Approximate Retail Value and the Actual Retail Value of any prize will not be awarded. Odds of winning Grand Prize are 1:3,000,000. FIRST PRIZE (1,000): One thousand (1,000) First Prize winners will each receive an Iron Man DVD. ARV of each First Prize: $20. Odds of winning First Prize are 1:3,000. SECOND PRIZE (2,000): Two Thousand (2,000) Second Prize winners will each receive an exclusive Iron Man Movie Poster. ARV of each Second Prize: $10. Odds of winning Second Prize are 1:1,500. No substitutions of any prize are permitted, except at the sole discretion of Sponsor. Sponsor will report value of prizes as required by law. All taxes are the sole responsibility of the winner. Please allow 8-10 weeks for delivery of Prizes. TOTAL COMBINED ARV OF ALL PRIZES: $47,500. Prizes claimed will be awarded at the end of the Promotion Period following winner verification. ONLY VERIFIED PRIZE CLAIMS WILL BE FULFILLED. UNCLAIMED PRIZES WILL NOT BE AWARDED.
  4. ELIGIBILITY: Must be the age of majority in your state of residence and a legal U.S. resident currently residing in AL, CT, DE, FL, GA, HI, IL, IN, KY, ME, MD, MA, MS, MT, NH, NJ, NY, NC, OH, PA, RI, SC, TN, UT, VT, VA, WV, WI, or Washington, DC. Employees (and household or family members of such employees) of Sponsor, respective affiliates, suppliers, advertising, promotion and fulfillment agencies and affiliates are not eligible. Failure to surrender winning Game Piece or to otherwise verify eligibility is grounds for disqualification. Grand Prize winner and each guest will be required to complete and return an Affidavit of Eligibility/Publicity Release and a Travel Release. In the event that any guest is a minor, that guest's parent or legal guardian, both on behalf of himself/herself and his/her minor child, must sign all Affidavits and Releases must be returned within seven (7) days of notification or Grand Prize will be forfeited and an alternate potential winner will be randomly selected if time permits.
  5. General Conditions: This Promotion is governed by the laws of the United States. Void where prohibited, taxed or otherwise restricted by law. All federal, state and local laws and regulations apply. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any sweepstakes-related activity and/or the legitimate operation of the Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  6. RELEASE AND LIMITATION OF LIABILITY: By participating in this promotion, entrants agree that Sponsor and its affiliates, subsidiaries, members, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives and agents (the "Released Parties") are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) unauthorized human intervention in any part of the entry process or the Promotion; or (3) technical or human error that may occur in the administration of the Promotion or the processing of entries.

    BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS PROMOTION OR IN ANY PROMOTION RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM.

    BY PARTICIPATING IN THIS PROMOTION, PARTICIPANTS AGREE THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY SWEEPSTAKES-RELATED WEBSITE ("THE WEBSITE"), OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY SUCH SITE.

    WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE WEBSITE AND ALL PRIZES, ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. EXCEPT WHERE PROHIBITED BY LAW, WINNER GRANTS TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, WINNER'S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON A TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.
